Can husband force wife to quit job? Read what the High Court said

Madhya Pradesh High Court has come up with an important comment regarding forcing the wife to quit her job. The High Court, while accepting a 33-year-old woman’s petition for divorce, has said that forcing a wife to leave her job and live according to his wishes and manners by her husband falls under the category of cruelty. A woman posted in Indore as a manager in a central government undertaking filed a divorce petition against her husband in a family court, alleging that he was mentally torturing her to leave her job and live with him in Bhopal. The family court rejected this application of the woman. After which the woman challenged this order of the family court in the high court.

What else did the High Court say?

A bench of Chief Justice Suresh Kumar Kait and Justice Sushrut Arvind Dharmadhikari of the High Court overturned the lower court’s decision on legal grounds and allowed the woman’s divorce petition. In its judgment on November 13, the bench said, “It is the choice of the husband or the wife whether they want to live together or not. Neither spouse can force the other party not to work or to work as per the spouse’s choice.” Forcing comes under the category of cruelty.

Raghvendra Singh Raghuvanshi, the woman’s lawyer, said, “After marriage in 2014, my client (client) and her husband were in Bhopal preparing for the government recruitment exam. In 2017, my party got a job in a government undertaking, but due to her husband’s ego, there was no employment. The damage started happening.” She said her party husband was allegedly harassing his wife posted as a manager in Indore. started harassing her and forced her to quit her government job and stay with him in Bhopal.

According to Raghuvanshi, the woman’s husband told her that whenever she did not get any job, she should not do any job either. He said, “Since the wife was not ready for this statement by her husband, the couple began to have differences. Disturbed by the husband’s mental torture, the woman finally decided to get a divorce (with language inputs).
