Exasperated by Uddhav Thackeray group’s Shiv Sena allegations, former CJI Chandrachud said- ‘Will a party call it a decision?’

New Delhi: Former Chief Justice of India DY Chandrachud Uddhav Thackeray has responded to the Shiv Sena group’s latest allegations. Justice Chandrachud said that my answer is very simple. Should a single party or individual decide which cases the Supreme Court should hear? What will the Supreme Court decide a party to decide? excuse me This is the job of the Chief Justice.

Sanjay Raut made this accusation against DY Chandrachud

Following the defeat of the opposition Maha Vikas Aghadi (MVA) in the recent Maharashtra assembly elections, Shiv Sena (UBT) leader Sanjay Raut alleged that Justice Chandrachud had violated the law by not deciding on petitions pending in the minds of state politicians. The fear of disqualification of MLAs has been removed. This left the door open to political defection and subsequent defeat. Sanjay Raut said that history will never forgive DY Chandrachud.

Answer given to Sanjay Raut

Answering a question related to Sanjay Raut’s allegations in an interview to news agency ANI, DY Chandrachud said that this whole year we have put a hold on fundamental rights, nine-judge bench decisions, seven-judge bench cases. A person or party must decide which cases the Supreme Court should hear. This power rests with the judge.

Uddhav’s government fell due to Eknath Shinde’s rebellion.

Let us tell you that after the rebellion of Eknath Shinde in the year 2022, the undivided Shiv Sena had to face division. This brought down the then ruling MVA government led by Uddhav Thackeray and formed the Mahayuti government led by Eknath Shinde. Following this, Thackeray along with Eknath Shinde petitioned the Supreme Court for disqualification of MLAs who had left the party.

The Supreme Court asked Assembly Speaker Rahul Narvekar to decide on the disqualification petitions of rival groups. In January this year, Speaker Shinde declared the group as the ‘real’ Shiv Sena, when asked about the Sena’s allegation against the UBT for delaying the decision on the Shiv Sena case, the CJI said, You see, this is the problem. The real problem is that a section of politics feels this way. We fixed the election bond. Was it less important? We have taken decisions this year on important issues related to the federal structure and these are all the things we have taken decisions on this year. We have decided on the constitutional validity of Section 6A of the Citizenship Act, which granted citizenship to certain persons.
