Supreme Court bans government’s arbitrariness on bulldozer action, says officials will be punished for taking illegal action

New Delhi: The decision of the Supreme Court on the bulldozer action has come. A bench of 2 judges gave this decision. The Supreme Court has banned the arbitrary action of the government and said that arbitrary demolition of houses is a violation of law. The Supreme Court said that states should have rule of law. Cannot take someone’s property arbitrarily. A building can be legally demolished even if someone is found guilty. Being accused and convicted is not a ground for housebreaking.

Officials will be punished for taking arbitrary action

The Supreme Court said that officials will be held responsible for using bulldozers arbitrarily on property. If an officer takes arbitrary and illegal action, he will be punished. It is the job of the court to punish for crime. Accused and convicted also have certain rights. Demolition of a house just because of the accused is a violation of the law.

SC asked for compensation

The Supreme Court has said that if a person’s house is arbitrarily demolished, he should get compensation. It is unconstitutional to operate a bulldozer without due process of law. The whole family cannot be punished for one person’s mistake. If there is only one accused, why should the house be taken away from the entire family?

Notice, 15 days time and hearing side of accused also

The Supreme Court said that the side of the accused should be heard before the bulldozer action. Notice should be issued as per rules. The notice should be sent by registered post and affixed to the house. Get 15 days time before proceeding. The information about the notice will also have to be given to the District Magistrate. The accused should be given an opportunity to remove the illegal construction.
