The Madras High Court has given a major relief to a youth facing allegations of sexual harassment. The court quashed the ongoing sexual harassment proceedings under Section 354A of the IPC. Meanwhile, the Madras High Court commented that hugging and kissing between a young man and a young woman in love is a natural thing. As reported by Live Law, while hearing the case, Justice Anand Venkatesh said that to commit the offense under Section 354-A-(1) (i) of the IPC, it is necessary for a man to have physical contact. .
What was the matter?
He said that hugging or kissing is a natural thing between two people who are in a romantic relationship during adolescence. This is not a crime of any kind. In fact, a person named Santhaganesh filed an application in the court. In this petition, she has sought quashing of the FIR lodged against her by the All Women Police Station. Santhaganesh alleged that the petitioner along with the complainant called him to a place on 13 November 2022. After this, the two had a conversation that day after which the appellant hugged and kissed the complainant.
The court said – there is no need to prosecute the case
When the complainant informed his parents about this incident. After this, when the petitioner was asked to marry her, she refused. After which a case was registered in this matter on behalf of the complainant. The court dismissed the case giving relief to the petitioner Santhaganesh in this case. The court held that even if the allegations are accepted as true, there is no such offense against the petitioner. Justice Anand Venkatesh said there was no legal need to do anything.
