The Supreme Court has delivered a major verdict on the bulldozer action on Wednesday. Justice BR Gavai on Wednesday quoted these lines from noted poet Pradeep to underline that everyone wants their own home and never wants to lose this dream. Issuing nationwide guidelines on demolition of properties, Justice Gawai began the 95-page judgment with lines from the poet, “Aapna ghar ho, apna angan ho, is khawab mein ki ki khawab ke liye jeet hai, manasak ke dil ki aa hai. Wish that May the dream of home never be lost.” The bench said, “The importance of famous poet Pradeep Ashiana is this. described in the manner.”
What was the decision of the court on the action of bulldozer?
Justice Gawai wrote the judgment for the bench. Justice K V Viswanathan is also included in the bench. The court said that every person and family has a dream of a house. “A house symbolizes the collective expectations of stability and security of every family or individual,” the bench said. Whether it is permissible to take away the shelter of his family or not. The bench said that the right to asylum is one of the aspects of Article 21 (protection of life and personal liberty) of the Constitution.
No property shall be demolished without notice
Laying down guidelines for the entire country, the court said that no property should be demolished without a show-cause notice and the affected should be given 15 days to respond. Taking a strict stand on ‘bulldozer justice’, the bench said the authorities cannot act as judges, convict the accused and demolish his house. A bench of Justices Gavai and Viswanathan said, “If the authorities demolish the house of a citizen merely on the ground that he is accused of a crime, it is acting against the principles of rule of law.
The court said that if a person’s house is demolished simply because he is accused or convicted, it would be “absolutely unconstitutional”. Delivering the judgment, Justice Gavai said that the executive cannot replace the judiciary in performing its core functions. (with language inputs)
